COVID-19 impact: UP-RERA extends project timelines by six months

Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has extended registration and completion of all the registered projects by six months. These projects include such projects whose registration or completion date has expired on or after March 25, 2020. The six months extension facility will be provided to those projects also which have already availed a one-year extension on or after March 25, 2020, as provided in RERA Act.

UP RERA has invoked force majeure clause under the RERA Act to grant this relaxation. The Centre has recently issued an advisory to the regulatory authorities across the states as well as the union territories in this respect and has allowed treating the COVID-19 pandemic as ‘Force Majeure’ or in the legal term an ‘Act of God’.

While the authority will issue new certificates f ‘Project Registration’ and it will not charge any fees for the aforesaid action. The authority has also taken the decision to extend the time limit for various necessary compliances.
